LAND CONSULTING SERVICES

Elexco Land Services, Ltd. offers a full range of land-related tasks from total land project management to small, one-time acquisitions. We specialize in resource land acquisition and management, pipeline and utility corridors, civic and transportation rights-of-way and easements, and document administration.

Land Consulting Details:

Elexco offers the following:

Fee simple acquisitions
Acquisition of new and renewal mineral / petroleum and natural gas rights
Pooling and unitization negotiations for the Oil and Gas Industry
Right-of-Way and Easements / Surface Use Acquisition (including assembly of utility corridors and pipeline routes)

Responding to direction provided by your technical team, our Land Managers will direct and supervise in-house landmen and land brokers in the execution of your required services.

From our experienced employee roster, we can ensure project staffing levels commensurate with clients’ timelines as well as the project size and scope. During the conduct of its field tasks, Elexco continues its “good neighbour” policy to mitigate future concerns and get the best benefit at competitive terms for the project.

RENEWABLE ENERGY SERVICES

Land rights for wind, solar, storage and the lines that connect them

Every renewable project depends on land, and land is where schedules are won or lost. A missed title defect, a stalled easement or an unhappy landowner can hold up a project that is otherwise ready to build.

Since 2004, Elexco has acquired options for more than 35 utility-scale renewable energy projects across the United States and Canada. We handle the full life of the land record: first landowner contact, acquisition, a title package that lender’s counsel will accept, and payment and obligation administration that continues long after commercial operation. Many of those projects are operating today.

We bring 50 years of land experience, in-house legal counsel and in-house GIS to every engagement. You can choose one service or the whole program.

Renewable Energy Details:

Wind

Wind projects involve large land footprints, many landowners, and agreements that must work for 30 years or more. Our team has supported wind development from early site control through operation. Our wind work includes:

Option and lease negotiation across multi-landowner project areas, including participation and good-neighbour agreements with adjacent owners.
Meteorological tower agreements for early resource assessment.
Access road, collection line and crane path easements.
Substation and laydown yard lease agreements.
Setback, wake and constraints mapping in coordination with the developer’s layout team.

Solar

Utility-scale solar concentrates large acreage on fewer parcels, which puts a premium on clean title, clear surface-use terms, and a working relationship with the agricultural community. Our solar work includes:

Purchase, option and lease negotiation, including staged option-to-lease structures.
Surface-use and crop-damage terms that reflect how the land is actually farmed.
Title and encumbrance review early in site selection, before a parcel becomes a problem.
Coordination of drainage tile, mineral and pipeline issues that commonly affect solar sites.
Public consultation and community outreach support.

Battery Energy Storage (BESS)

Storage sites are compact, but they face scrutiny from local communities, fire authorities and interconnection timelines. Our storage work includes:

Site control for standalone storage facilities.
Lease negotiation that accounts for augmentation, repowering and decommissioning.
Access and interconnection easements to the point of interconnection.
Title and zoning diligence to support permitting.

Interconnection and Access

Generation-tie and interconnection right-of-way is often the last land piece to fall into place, and it can decide when a project reaches commercial operation. We apply the same corridor discipline we have used on more than 4,500 kilometres (2,800 miles) of pipeline and utility ROW. Our interconnection work includes:

Generation-tie and transmission right-of-way acquisition.
Crossing agreements with railroads, pipelines, highways and utilities.
Access road easements, rights of entry, and survey and environmental study permissions.
Route alternatives and re-route mapping when a parcel will not sign.
Regulatory compliance support through permitting and approvals.

Construction and Beyond

The land file doesn’t close at commercial operation. Elexco stays with the project for its life. Our long-term services include:

Landowner liaison through construction, and damage settlement on the same “good neighbour” basis we have used for 50 years.
Payment administration covering initial, recurring, damage and non-recurring payments, with year-end tax slip preparation.
Rental review under lease escalation and review provisions.
Obligation and deadline tracking across the portfolio, with real-time client reporting.
Document and data management held to a defined retention and access policy.

GIS/MAPPING SERVICES

Our Mapping Department consists of highly skilled GIS technicians who have developed customized mapping systems, stored in a centralized data warehouse, for use in-house and at remote locations. Our technicians have the capabilities to integrate and convert existing client maps and data into our system as well as create new areas.

Elexco’s Land Assessment© computer program performs complex land management tracking and is tied to Ontario government data. This program comprehensively tracks the client’s land acquisition process from start to finish, providing the client with unique progress reports and snapshots of progress at any given time throughout the life of the client project.

Elexco’s Land Scan© PC-based computer program is offered as a value-added service to Elexco’s Southwestern Ontario oil and gas clientele. This service provides data on competitive leasing/leaseholds and is provided at a nominal cost as part of a leasing contract.

Elexco’s Time Management Program© allows for comprehensive client/contract/project tracking to assist the client in evaluating their outsourcing and budgeting scenarios, with monthly breakdowns of time and disbursements.

Our in-house programs:

Efficiently organize records and data resulting in the expedient handling of various payment requirements from considerations and bonus payments to rental and royalty distribution.
Produce detailed reports for historical and tax reporting purposes.
Continued upgrades and enhancements allow customization for client requests and industry changes to further strengthen file management resources.
Provide fast response time on client, landowner and lawyer queries through a large variety of indexing and search methods.
